INTRODUCTION AND PREAMBLE (EU-READY ORGANISER VERSION – GEZENTHI TRAVEL AGENCY)
These General Terms and Conditions of Sale (“TCS”) govern the contractual relationship between Uysel Turizm Sanayi ve Ticaret A.Ş., trading as Gezenthi Travel Agency, having its registered office at Sair Esref Bulvari No:57 D.2 Alsancak 35220 Izmir / Türkiye, and the traveller (“Traveller” or “Customer”).
Gezenthi Travel Agency organises and sells excursions, multi-day tours, cultural activities, transport services and other travel-related experiences either directly through its websites or through authorized sales partners.

By completing a booking through any Gezenthi Travel Agency sales channel, the Traveller confirms that they have read, understood and accepted these Terms and Conditions. These Terms apply to all bookings unless otherwise expressly agreed in writing.
ROLE OF THE ORGANISER
Unless explicitly stated otherwise in the booking confirmation, Gezenthi Travel Agency acts as the organiser of the package travel services. As organiser, Gezenthi Travel Agency is responsible for the proper performance of the travel services included in the contract in accordance with Turkish Tourism Law No. 1618, Consumer Protection Law No. 6502, the Regulation on Package Tour Contracts dated 14.01.2015, and internationally recognised package travel principles commonly applied within the European Union and the United Kingdom.
PRE-CONTRACTUAL INFORMATION
Before the conclusion of the contract, Travellers receive clear and comprehensible information regarding:
• the main characteristics of the travel services,
• the total price of the package,
• payment conditions,
• cancellation and modification rights,
• minimum participant requirements where applicable, and
• essential traveller rights.
By confirming a booking, the Traveller acknowledges that all required pre-contractual information has been provided via the Gezenthi Travel Agency website or authorised communication channels.
PACKAGE TRAVEL RIGHTS NOTICE
The combination of travel services offered to the Traveller may constitute a package tour within the meaning of Turkish Tourism Law. Where a booking qualifies as a package, the Traveller benefits from enhanced protection, including:
• responsibility of the organiser for proper performance of the services,
• the right to transfer the package to another person under certain conditions,
• transparent cancellation conditions and justified termination fees,
• protection in the event of organiser insolvency, and
• assistance if the Traveller encounters difficulties during the trip.
FINANCIAL PROTECTION AND INSOLVENCY COVER
Gezenthi Travel Agency maintains financial protection as required by Turkish Tourism Law No. 1618. In the event of insolvency, Travellers are entitled to reimbursement of payments made for services not performed and, where transport is included, assistance with repatriation where applicable.

INTERNATIONAL CUSTOMER PROTECTION
Although these Terms are governed by Turkish law, nothing within these Conditions removes or limits mandatory consumer protection rights granted to Travellers under applicable laws in their country of residence, including rights commonly recognised under European and United Kingdom package travel regulations.
ACCEPTANCE OF TERMS
Placing an order or confirming a reservation constitutes full acceptance of these General Terms and Conditions of Sale, which prevail over any conflicting terms unless expressly agreed otherwise by Gezenthi Travel Agency.
STANDARD TRAVELLER RIGHTS
Before concluding the contract, passengers will receive all necessary information about the package travel services.
The organiser and any authorised retailer are responsible for the proper performance of the travel services included in the contract, irrespective of whether such services are performed by third-party suppliers.
Passengers will be provided with an emergency contact number enabling them to reach the organiser or a designated local representative during the trip.
Passengers may transfer their package to another traveller meeting the same conditions, subject to reasonable notice and any additional costs incurred.
Price increases may only occur where expressly provided for in the contract and limited to increases in transport costs, fuel prices, taxes or exchange rates. No price increase shall be applied within 20 days prior to departure.
Travellers may terminate the contract at any time before the start of the package by paying an appropriate and justified termination fee.
If, after departure, a significant portion of the services cannot be provided as agreed, suitable alternative arrangements will be offered without additional cost where possible.
ARTICLE 1 – RESERVATION AND CONTRACT FORMATION
All tours and excursions must be reserved in advance. A booking becomes binding once payment has been received and confirmation has been issued by Gezenthi Travel Agency.
The Customer agrees to provide accurate booking details including participant names, contact information, travel dates, and pick-up information where applicable. Failure to provide required operational details may affect service delivery.
ARTICLE 2 – CUSTOMER CANCELLATION, REFUNDS AND PAYMENT-PROVIDER COMPLIANT POLICY
(EU & UK ORGANISER VERSION)
This policy is written in accordance with internationally recognised package travel principles and consumer protection standards commonly applied within the European Union and the United Kingdom. The purpose of this clause is to provide transparent, fair and proportionate cancellation conditions.
2.1 How to Request a Cancellation or Modification
All cancellation or modification requests must be submitted in writing via the Gezenthi Travel Agency contact page or by email to info@gezenthi.com.
The effective cancellation date will be the date on which the written request is received by the organiser.
Telephone requests cannot be accepted as formal cancellation notices.
2.2 Traveller’s Right to Cancel
The traveller may terminate the package travel contract at any time before the start of the services. Where a cancellation occurs, Gezenthi Travel Agency may apply a reasonable termination fee reflecting:
- the timing of the cancellation,
- expected cost savings, and
- the possibility of reselling the travel services.
The following scale represents a genuine estimate of losses and operational costs unless otherwise specified at the time of booking:
Daily Tours
- Up to 24 hours before departure – No cancellation fee
- Less than 24 hours – Up to 100% of the total price
Event Tickets and Time-Specific Admissions
- May be non-refundable once issued, except where mandatory law provides otherwise
Multiday Tours Including Accommodation
- Up to 14 days before departure – No cancellation fee
- 13 days or less – Up to 100% of the total price
Group Excursions and Multiple-Day Programs
- Up to 31 days before departure – No cancellation fee
- 30 to 16 days – Up to 50% of the total price
- 15 days or less – Up to 100% of the total price
Cancellation charges shall never exceed the total price of the package.
2.3 Extraordinary Circumstances
Notwithstanding the cancellation scale above, the traveller has the right to terminate the contract without paying any cancellation fee if unavoidable and extraordinary circumstances occur at the destination or its immediate vicinity and significantly affect:
- the performance of the package, or
- the transport of passengers to the destination.
Examples may include serious safety risks, natural disasters, or government-imposed travel restrictions.
2.4 Changes or Cancellation by the Organiser
Gezenthi Travel Agency reserves the right to cancel or modify travel services where necessary for safety, operational reasons, or force majeure, including but not limited to severe weather conditions, administrative decisions, strikes, or unforeseen closures.
If the organiser cancels the package before departure, travelers will be offered:
- a full refund of payments made, or
- an alternative package where available.
2.5 Refund Processing (Payment-Provider Compliance)
Where a refund is due, Gezenthi Travel Agency will process the reimbursement using the original method of payment unless otherwise agreed.
Refunds will be issued without undue delay and generally within fourteen (14) days following confirmation of eligibility.
Processing times may vary depending on the traveller’s bank or payment provider.
2.6 No-Show and Voluntary Departure
Failure to attend the departure at the scheduled time or voluntary interruption of services after the start of the package may be treated as a cancellation with 100% charges applicable, except where mandatory consumer law provides otherwise.
2.7 Fairness and Transparency
All cancellation charges reflect genuine operational losses, supplier commitments, and administrative costs. Nothing in this clause affects the traveller’s mandatory legal rights under applicable consumer protection laws.
ARTICLE 3 – PRICES
Prices include the services specified in the booking description and are quoted per person unless otherwise stated. VAT is included where applicable. Promotions apply only to bookings made through the specified sales channel.
ARTICLE 4 – PAYMENT TERMS
Unless otherwise agreed, payment is required in full at the time of booking. Failure to complete payment may result in cancellation of the reservation.
ARTICLE 5 – TRANSFER OF CONTRACT
Customers may transfer the booking to another traveller meeting the same conditions by providing reasonable notice prior to departure. Both parties remain jointly responsible for payment of any outstanding balance and transfer costs.
ARTICLE 6 – LIABILITY AND RESPONSIBILITY OF THE ORGANISER (EU-READY ORGANISER LIABILITY CLAUSE)
6.1 Responsibility for Performance of the Package
Gezenthi Travel Agency acts as the organiser of the package travel services and is responsible for the proper performance of the travel services included in the contract, irrespective of whether such services are to be performed by third-party suppliers such as transport companies, accommodation providers, guides or local operators.
Where any travel service is not performed in accordance with the contract, Gezenthi Travel Agency will take appropriate measures to remedy the lack of conformity unless this is impossible or involves disproportionate costs.
6.2 Limits of Liability
Gezenthi Travel Agency shall not be liable where the lack of conformity is attributable to:
- the traveller, including failure to follow reasonable instructions;
- a third party unconnected with the provision of the travel services and where the consequences could not have been avoided.
- unavoidable and extraordinary circumstances beyond the organizer’s control.
Nothing in this clause excludes liability where limitation is not permitted under applicable mandatory law.
6.3 Assistance to Travellers
If a traveller is in difficulty during the trip, Gezenthi Travel Agency will provide appropriate assistance without undue delay, including:
- information on health services and local authorities,
- assistance with distance communications, and
- help with alternative travel arrangements where necessary.
Reasonable fees may be charged where the difficulty is caused intentionally or through negligence by the traveller.
6.4 Personal Belongings
Travellers remain responsible for their personal belongings during transport, excursions and activities. Unless required by mandatory law, Gezenthi Travel Agency cannot be held responsible for loss, theft or damage to personal items unless caused by proven negligence of the organiser or its suppliers.
Travellers are advised not to leave luggage unattended in vehicles or at agency premises.
6.5 Travel Documents and Compliance Outside Türkiye
For tours or excursions outside Turkish territory, travellers are solely responsible for ensuring they possess valid passports, visas and any required travel documents. Gezenthi Travel Agency cannot be held responsible for denied entry resulting from incomplete or invalid documentation.
6.6 Behaviour and Safety
Travellers agree to respect applicable laws, safety rules and instructions provided by guides, drivers and staff. Gezenthi Travel Agency reserves the right to refuse participation or remove any traveller whose behaviour presents a risk to themselves or others, without entitlement to compensation where such action is justified for safety reasons.
6.7 Alcohol, Drugs and Prohibited Conduct
Gezenthi Travel Agency shall not be liable for incidents, damages or injuries resulting from travellers being under the influence of alcohol, drugs or prohibited substances, or from behaviour contrary to public safety regulations.
6.8 Interruption or Voluntary Withdrawal
If a traveller voluntarily interrupts or leaves a tour after it has begun, no refund will be due for unused services unless otherwise required by mandatory consumer law. From the moment of voluntary departure, Gezenthi Travel Agency shall be released from further performance obligations related to the unused portion of the package.
6.9 Mandatory Consumer Rights
Nothing in this Article limits or excludes rights granted to travellers under applicable consumer protection legislation or mandatory package travel regulations.
ARTICLE 7 – APPLICABLE LAW, JURISDICTION AND DISPUTE RESOLUTION (EU-FRIENDLY CROSS-BORDER VERSION)
7.1 Governing Law
These General Terms and Conditions of Sale and any agreement concluded with Gezenthi Travel Agency shall be governed by and interpreted in accordance with the laws of the Republic of Türkiye.
However, nothing in this clause shall deprive travellers of mandatory consumer protection rights granted under applicable laws in their country of habitual residence where such protections cannot be contractually excluded.
7.2 Amicable Resolution and Customer Support
In the event of a dispute relating to the interpretation or performance of these Terms and Conditions, the traveller is encouraged to contact Gezenthi Travel Agency first in order to seek an amicable solution.

Gezenthi Travel Agency will make reasonable efforts to resolve disputes quickly and fairly through direct communication.
7.3 Alternative Dispute Resolution
Where a dispute cannot be resolved directly, travellers may use mediation or other alternative dispute resolution methods where available. The use of such procedures is voluntary and does not prevent either party from exercising their legal rights before a competent authority.
7.4 Jurisdiction
Unless mandatory consumer law provides otherwise, disputes arising from these Terms and Conditions shall fall under the jurisdiction of the competent courts of Türkiye.
Where the traveller is a consumer residing in the European Union or the United Kingdom, mandatory rules granting the right to bring proceedings before local consumer courts shall remain unaffected.
7.5 Severability
If any provision of these Terms and Conditions is declared invalid or unenforceable by a competent authority, the remaining provisions shall remain fully valid and enforceable.
